Abstract

Le libellé, la justification et la genèse de l’article 4 (h) de l’Acte constitutif de l’Union africaine (UA) suggèrent fortement que les fondateurs de cette organisation régionale n'avaient pas l’intention de remettre en cause le système de sécurité collective de la Charte des Nations Unies. Le texte, en ne faisant nulle mention d’une éventuelle autorisation du Conseil de sécurité, a simplement conféré à l’UA une compétence juridique interne, nécessaire à une intervention sur le territoire de ses États membres en cas de génocides, crimes de guerre et crimes contre l’humanité. Cette interprétation est conforme au système de sécurité régionale mis en place par le Protocole relatif à la création du Conseil de paix et de sécurité, au système de défense commune établi par le Pacte de non-agression et de défense commune ainsi qu’à la pratique de l’Union et ses États membres qui n’ont jamais revendiqué une exception régionale au droit de la Charte des Nations Unies.
