A Judicialização da Política é um fenômeno experimentado em diversas democracias do mundo e vem ganhando espaço cada vez maior na mídia e outras arenas de debate. Tem sido observada em diversas áreas, como a área eleitoral, impactando o processo eleitoral e sendo incorporada às estratégias dos atores políticos envolvidos nos processos decisórios. Este artigo tem o objetivo de refletir sobre a judicialização da política e a ocorrência deste fenômeno no âmbito eleitoral, especialmente no cenário brasileiro. Para tanto, pretende-se apresentar uma discussão sobre o conceito, as condições facilitadoras e outras questões envolvendo a temática deste artigo. Pretende-se ainda verificar a ocorrência deste fenômeno na esfera eleitoral, focando-se no Tribunal Superior Eleitoral (TSE) e nas motivações que podem ter os atores políticos ao judicializar o processo político-eleitoral. Trata-se de uma pesquisa qualitativa com o uso da técnica de revisão bibliográfica. Para tanto, será utilizada a literatura nacional e internacional especializada no tema. Admite-se que o fenômeno da judicialização da política, apesar da crítica direcionada a este fenômeno, não é uma distorção política ou social, pois ocorre com base em disposições legais, normalmente constitucionais, que colocam o Poder Judiciário como protagonista na arena das decisões políticas, que, por excelência, deveria ser do Executivo ou Legislativo. A proximidade entre a jurisdição eleitoral, que no Brasil é exercida pela Justiça Eleitoral; e a atividade política, especialmente a eleitoral, colabora para a observação deste fenômeno no âmbito da competição político-eleitoral.
