“Catraca Livre” e a possibilidade de ampliação morfológica do direito fundamental à greve: considerações jurídicas e estratégicas

Abstract
O objetivo deste estudo é analisar a legalidade da modalidade de greve denominada "catraca livre". Consagrada pelo setor de transportes, a "catraca livre" envolve a recusa dos trabalhadores em cobrar dos passageiros para acessar ônibus, trens ou metrôs, mantendo suas atividades e causando prejuízos ao empregador sem afetar negativamente a população em geral. Esta forma de movimento grevista tem ganhado destaque no Brasil contemporâneo, especialmente entre os metroviários de São Paulo, que desafiam constantemente o Governo do Estado a reconhecerem essa prática como uma alternativa válida à greve tradicional, evitando impactos negativos à população. No entanto, esse tipo de greve tem amparo legal? Para responder a essa pergunta, esta pesquisa utiliza uma abordagem bibliográfica, exploratória, descritiva e interpretativa de natureza qualitativa. A análise é conduzida por meio de pesquisa bibliográfica e documental, empregando o método materialista histórico-dialético e estudos de caso para examinar a legislação, jurisprudência e doutrina pertinentes. Os resultados deste artigo indicam que a "catraca livre" se encaixa dentro do escopo legal estabelecido pelo artigo 9 da Constituição, que, por não definir o conceito de greve, permite uma interpretação abrangente do instituto. Além disso, a cláusula de "suspensão parcial do trabalho" presente no artigo 2º da Lei de Greve pode ser interpretada de maneira a abranger diversas formas de perturbação da normalidade da produção, incluindo a "catraca livre", bem como greves de zelo e greves de rendimento.
