Abstract
L’arbitrage est actuellement un mode essentiel de règlement des différends dans les rapports contractuels entre particuliers ainsi qu’entre organes des États. L’exécution de la sentence arbitrale constitue une phase très importante pour l’efficacité de l’arbitrage qui est un moyen volontaire et rapide. La sentence arbitrale, avant l’ordonnance d’exequatur, n’est qu’une simple décision, rendue par une personne privée, qui ne possède pas l’imperium. Ainsi, la sentence arbitrale n’est pas d’office exécutoire. Lorsque les parties refusent l’exécution volontaire. Cette exécution est assujettie à l’ordonnance d’exequatur. Le juge de l’exequatur doit refuser l’exequatur s’il estime que sont absents les éléments contraires à l’exécution de la sentence interne, comme la violation flagrante de l’ordre public interne.
