Abstract
O artigo buscou analisar o surgimento do bem de família e da propriedade fiduciária, destacando a impenhorabilidade do imóvel residencial como forma de proteger o direito à moradia da família. A impenhorabilidade é regulamentada pela Lei nº 8.009/90, abrangendo não apenas o imóvel em si, mas também a construção, as plantações, as benfeitorias de qualquer natureza e todos os equipamentos e móveis que guarnecem a casa. Além disso, a propriedade fiduciária é apresentada como uma modalidade de garantia em que o devedor transfere a propriedade de um bem ao credor fiduciário até que a dívida seja quitada, regulada pela Lei 9.514/97. Destaca-se a recente determinação da 3ª Turma do Superior Tribunal de Justiça (STJ) para que o Tribunal de Justiça de São Paulo analise a presença dos requisitos legais para o reconhecimento de um imóvel alienado fiduciariamente como bem de família. O relator do recurso especial, ministro Villas Bôas Cueva, ressaltou que a regra de impenhorabilidade do bem de família também abrange os imóveis em fase de aquisição, como os objetos de compromisso de compra e venda ou de financiamento para fins de moradia. Além disso, o artigo aborda o conceito e as características da propriedade fiduciária, destacando a transferência resolúvel de um bem móvel infungível, a constituição da propriedade fiduciária com o registro do contrato, o desdobramento da posse e a forma como a propriedade fiduciária de bens imóveis se dá por meio de um negócio jurídico condicional.
