A pobreza e a desigualdade social estão fielmente interligadas. Dessa forma, elas não existem de maneira isolada. Com a promulgação da Constituição Federal, de 1988, o Estado comprometeu-se com a diminuição da pobreza e da desigualdade social, porém, isso nunca se deu de maneira sistêmica, buscando atingir as raízes desses problemas, senão com medidas imediatistas e inócuas, sem a solução definitiva dessas mazelas. O presente artigo procurou analisar os dados pertinentes às políticas públicas brasileiras, com destaque, para o Auxílio Emergencial, implementado em 2020. Para isso, realizou-se uma pesquisa dogmático-jurídica, consoante o método hipotético-dedutivo, a partir da análise qualitativa, com base em evidências científicas, mediante a revisão da literatura especializada a respeito do assunto, considerando as fontes teórico-doutrinárias e legais, pertinentes ao assunto. Como resultado, chegou-se à conclusão de que a persistência da pobreza e da desigualdade nacionais, desde a Ditadura Militar até os dias de hoje, deve-se à inadequação das medidas tomadas pelo Estado brasileiro.
