ASSURANCE COLLECTIVELa nouvelle loi sur l'assurance en Alberta et ses consquences pour les promoteurs de rgime La nouvelle loi sur les assurances de l'Alberta, la Insurance Act, a pris effet le 1er septembre 2001.Bien que cette loi vise principalement accrotre la responsabilit financire des compa gnies d'assurance et amliorer la protection du consommateur, les promoteurs de rgime et les professionnels du domaine de l'assu rance ont exprim des inquitudes quant l'impact des nouvelles rgles portant sur les rgimes autoassurs.Les nouvelles disposi tions auront notamment une incidence sur les programmes grs et financs par le promoteur et sur les programmes de services admi nistratifs seulement (SAS), c'est--dire ceux dont l'administration (adhsion, versement des prestations, rsiliation, etc.) est donne en impartition un assureur ou un tiers administrateur.Les nouvelles dispositions lgislatives s'appliquent tous les rgimes qui couvrent des rsidants de l'Alberta, que le promoteur du rgime se trouve dans la province ou ailleurs.Un grand nombre de promoteurs offrent leurs employs des rgimes d'avantages sociaux autoassurs, la gestion de ces rgimes tant plus souple et considrablement moins coteuse que celle des rgimes assurs.Nanmoins, le gouvernement de l'Alberta est sou cieux du risque financier auquel les participants ces rgimes sont exposs en cas d'insolvabilit du promoteur.Le refus de verser les prestations d'invalidit de longue dure aux employs des magasins Eaton aprs la faillite de cette entreprise en est le meilleur exemple.Les promoteurs ont donc en principe jusqu'au 1er septembre 2002 pour convertir leurs rgimes autoassurs et leurs programmes SAS en rgimes assurs.A la fin de la priode de transition, tous
