Abstract
La presente investigación centra su análisis en el uso de la acción de “Habeas Corpus” mismo que se encuentra establecido en la Constitución de la República del Ecuador en el 2008, como una garantía constitucional, y también se lo especifica en la Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional del 2009; esta acción es comúnmente utilizado por los profesionales del derecho para la otorgación de otras medidas cautelares diferentes a la prisión como, el arresto domiciliario o presentación periódica ante un Juez, beneficiando de esta manera tanto a personas privadas de la libertad con o sin sentencia ejecutoriada. La temática se justifica plenamente debido a que en los últimos meses han existido casos de conmoción por el mal uso de esta garantía jurisdiccional. Se planteo como objetivo de la investigación: “Determinar aquellos procedimientos o vacíos legales aplicados en la acción de Habeas Corpus aprovechados por las personas privados de libertad de la ciudad de Esmeraldas, para obtener su inmediata libertad durante el año 2021”. Para llevar a cabo la presente investigación, se aplicó la metodología cualitativa, además, de aplicarse técnicas como la revisión bibliográfica o documental, y analítica-sintética.
