Abstract
L’Accord entre le Gouvernement du Canada et le Gouvernement des États-Unis d’Amérique pour la coopération en matière d’examen des demandes de statut de réfugié présentées par des ressortissants de pays tiers, également connu sous le nom d’Entente sur les tiers pays sûrs, a subi une modification significative avec l’entrée en vigueur de son Protocole additionnel en mars 2023. Ce protocole a conduit à un renforcement de la frontière canado-américaine, éliminant pratiquement tout point de passage qui échappait à la gestion commune des demandes d’asile entre les deux pays, à l’exception d’un délai de 14 jours où un demandeur se verra retourner vers son dernier pays de séjour. Cet article offre une première analyse juridique des changements qui ont eu lieu à la frontière canado-américaine. Ces éléments mettent en lumière les dynamiques complexes qui influencent la politique d’asile et de migration à la frontière canado-américaine.
