Este artigo observa a gestão de resíduos sólidos em pequenos municípios, analisando a legislação municipal e os Planos Municipais de Gestão Integrada de Resíduos Sólidos (PMGIRS). Apesar de a Política Nacional de Resíduos Sólidos (PNRS) estabelecer diretrizes para uma gestão sustentável, foi constatado que muitos municípios carecem de legislação específica, resultando em planos de gestão pouco práticos e deficientes. A pesquisa, focada na microrregião de Wenceslau Braz/PR, revelou que a maioria dos municípios não possui uma Política Municipal de Resíduos Sólidos (PMRS) formalizada. Além disso, 100% dos PMGIRS analisados são incompletos e genéricos. Ao final, concluiu-se que há a necessidade da positivação jurídica da PMRS nos entes municipais, não só para orientar claramente na elaboração dos PMGIRS, mas, principalmente, para garantir uma base legal sólida e alinhada aos preceitos obrigatórios da PNRS. Por fim, a pesquisa revela que a instituição da PMRS no âmbito municipal repercutirá na continuidade das políticas de gestão e planejamento eficiente, elementos esses, fundamentais para a promoção de uma gestão eficiente e sustentável dos resíduos sólidos.
