Abstract
Actuellement, les membres du Sénat canadien sont nommés, aux termes de la Loi constitutionnelle de 1867, par le gouverneur général qui, en vertu des conventions constitutionnelles, agit de l'initiative et sur l'avis du premier ministre du Canada. Dans quelle mesure est-il possible de mettre en place, sans modification constitutionnelle formelle, par l’entremise de nouvelles conventions constitutionnelles, un mode différent de désignation des sénateurs? Dans cet article, l’auteur examine l’hypothèse de la désignation des sénateurs par l’exécutif fédéral à la suite d’une consultation électorale tenue dans les provinces, ainsi que celle d’une désignation faite par ces mêmes autorités sur proposition de personnes par le gouvernement de la province à représenter.
