Abstract
Dans le présent texte, les auteurs offrent une analyse qualitative du Journal des débats. Ils rendent compte de la conversation parlementaire au sujet de la modification de la Charte des droits et libertés de la personne, de sa création en 1975 jusqu’en 2022. Durant cette période, les élus ont apporté de nombreuses modifications à cet instrument quasi constitutionnel avec l’appui de tous les bancs de l’Assemblée nationale du Québec. Les députés ont longtemps souscrit à la pratique de modification par consensus, conférant à la Charte une légitimité et une autorité morale accrues. Ils ne se sentaient cependant pas liés par cette pratique, qui ne relève donc pas d’une convention constitutionnelle. En 2019 et en 2022, l’adoption de modifications importantes dans le contexte de lois largement rejetées par l’opposition interrompt la pratique consensuelle. Le statut de la Charte comme projet collectif des élus québécois est en jeu dès lors que l’exercice du pouvoir de la majorité supplante la recherche d’un consensus.
