Abstract
La littérature juridique moderne s’est intéressée à la collégialité des tribunaux et aux processus décisionnels qui s’y rattachent. Cependant, contrairement à d’autres pans de l’activité judiciaire, la dimension historique du phénomène, au Québec, est encore largement inexplorée. C’est ce sujet qu’aborde l’auteur en proposant une réflexion sur la culture de la collégialité entre juges et en examinant à cette fin le fonctionnement de la Cour du banc de la Reine/du Roi du Québec à l’époque où elle est dirigée par le juge en chef sir Alexandre Lacoste. Cette institution structurellement collégiale est en effet un modèle de collégialité délibérative, doublée d’une forte collégialité informelle. Les documents qu’elle a laissés en donnent maints exemples, qui permettent de saisir comment les pratiques internes d’un tribunal, souvent méconnues, influencent la qualité de son fonctionnement et de ses jugements, renforçant ainsi l’administration de la justice.
