La Cour canadienne de l’impôt est le tribunal qui a, entre autres, compétence pour entendre les appels de cotisations d’impôt par les contribuables, au fédéral. Qualifié d’être parmi les domaines du droit les plus complexes au Canada, le droit fiscal est un domaine opaque et parfois incompréhensible même pour les contribuables les plus aguerris. Cette opacité, à elle seule, peut apparaître comme un frein à l’accès à la justice, surtout qu’un nombre important de contribuables se représentent seuls contre la partie intimée, l’Agence du revenu du Canada. La Cour canadienne de l’impôt compte tout de même des mesures visant à rendre le litige fiscal plus facilement accessible aux contribuables. La Cour canadienne est une cour itinérante qui se déplace dans plusieurs villes du Canada. L’accès géographique à la Cour est un aspect important dans l’accès à la justice mais n’est certainement pas le plus central. La Cour a mis en place une foule de mesures visant à diminuer les obstacles procéduraux pouvant empêcher les contribuables d’accéder pleinement au tribunal. Néanmoins, comme tente de le démontrer cet article, l’accès à la justice est une question qui se définit bien au-delà de ce que peut faire la Cour canadienne de l’impôt et doit impliquer toutes les parties prenantes dans une approche holistique.
