Bien que l’idée d’exploration spatiale soit souvent liée à des scénarios de science-fiction, elle sert des objectifs essentiels à la qualité de la vie humaine sur Terre. La découverte scientifique est au coeur de l’exploration spatiale et cette dernière a très souvent contribué aux inventions scientifiques les plus importantes. L’un des domaines scientifiques qui a progressé grâce à l’exploration spatiale est celui de la médecine. En effet, une grande partie des technologies actuellement utilisées en médecine diagnostique et interventionniste, notamment dans les domaines de l’imagerie médicale et du traitement du cancer, proviennent de l’exploration spatiale et des essais médicaux réalisés dans l’espace. En même temps, l’utilisation de l’intelligence artificielle (IA) joue un rôle croissant dans les activités spatiales et celle-ci est de plus en plus utilisée dans le contexte de l’exploration spatiale, y compris à des fins médicales. Cet article examine les défis liés au transfert vers la Terre des connaissances et technologies médicales développées dans l’espace, un patrimoine commun de l’humanité, en accordant une attention particulière à l’IA en tant que créateur potentiel de ces connaissances et technologies. Dans ce contexte, le présent article traite des questions liées à l’établissement de droits de propriété intellectuelle pour les inventions dans l’espace et, tel que le prévoit le droit international de l’espace, à l’importance d’assurer un accès inclusif aux bénéfices tirés de l’espace.
