Les systèmes de droit civil entretiennent une conception du temps qui diffère à plusieurs égards des systèmes de common law. Si la présence d’un droit codifié assure une certaine stabilité du droit dans la tradition civiliste, c’est plutôt la règle du précédent qui joue ce rôle en common law. En droit québécois, la coexistence de ces deux traditions juridiques crée des tensions. Cette mixité des sources et des méthodes est d’autant plus frappante en matière de contrôle judiciaire des actes de l’administration publique, où les décisions des tribunaux viennent infléchir les principes énoncés au Code de procédure civile. L’auteur aborde l’une de ces règles, soit le délai pour agir en contrôle judiciaire. Il conclut que la règle du délai raisonnable en droit québécois est sujette à une méthode d’interprétation distincte par rapport aux délais qui existent dans les autres provinces canadiennes régies par la common law.
