Abstract
كما تتأثر التقنيات التكنولوجية بالقانون، فإنها تؤثر فيه، فمن ناحية أولى: فإن تطور التكنولوجيا له فوائد جمّة للجهات الإدارية؛ مما يزيد من كفاءتها وفعاليتها افتراضيًّا، ومن ناحية أخرى: تنطوي تحولات التكنولوجيا -لما لها من تأثير عميق- على تطور الإدارة، بل على وجودها أصلًا، ومنذ عام 2000 إلى يومنا هذا والتحولات الرقمية الممارَسة داخل المرافق العامة تأخذ أشكالًا متعددة، حتى وصلت لما عليه اليوم من استخدامات متعددة للخوارزميات ورقمنة النشاط الإداري .لقد تناول هذا البحث الإشكاليات النظرية والتطبيقات العملية الناتجة عن التحول الرقمي وتطور تكنولوجيا المعلومات "بالخصوص" داخل المرافق العامة. وتبيان ماهية التحول الرقمي وصوره وتطبيقاته المتعددة في الدول الغربية، وبيان التشريعات التي اتخذتها تلك الدول للتحول الرقمي؛ وذلك إما بتخصيص تشريعات له بصورة متفردة، أو إدراج نصوص تشريعية تحثّ على التحول الرقمي للإدارات العامة ضمن سياق تشريعات متعددة تهدف إلى التوسع في التكنولوجيا داخل المرافق العامة وتقليل الفجوة الرقمية. وتم استعراض عدة قوانين خاصة بالتحول الرقمي داخل الإدارات العامة منها قانون CRPA الفرنسي، وكذلك قانون الجمهورية الرقمية الفرنسي ، وقانوني CAD وMADIA الإيطاليين، وكذلك قانون التحول الرقمي للإدارة العامة في كندا، واللائحة العامة لحماية البيانات بالاتحاد الأوروبي. كذلك ناقش البحث أهم تطبيقات التحول الرقمي داخل المرافق العامة؛ كمرفق التعليم ومرفق القضاء، وبيان الإشكاليات التي واجهت هذا التطبيق.
