Abstract
O presente artigo busca investigar, a partir da análise do Tema n. 484 da Repercussão Geral do Supremo Tribunal Federal, a possibilidade de se utilizar a Constituição Federal como parâmetro direto no controle abstrato de constitucionalidade estadual. Primeiro, é traçado um panorama geral do Tema n. 484 e dos precedentes da Corte sobre o assunto. Em seguida, é realizado um estudo contextual da Reclamação n. 383/SP, precedente paradigma anterior ao Tema n. 484. Posteriormente, o artigo debruça-se sobre o julgamento do referido tema da repercussão geral, analisando o acórdão, os julgados citados como precedente e a tese fixada. Por conseguinte, é averiguado como o Tema n. 484 está sendo aplicado como precedente a partir das Ações Diretas de Inconstitucionalidade n. 5.646/SE e n. 5.647/AP. Conclui-se que o Tema n. 484, que a um primeiro momento pareceu reafirmar a Reclamação n. 383/SP, em realidade está levando a uma superação desse precedente – devido à redação dúbia conferida à tese e ao uso equivocado de precedentes – e tornando possível que os Tribunais de Justiça julguem representações de inconstitucionalidade tendo como parâmetro a Constituição Federal, quando se tratar de norma de reprodução obrigatória.
