Abstract
تهدف هذه الدّراسة إلى البحث في نطاق مسؤوليّة الناقل الجوي في عقد نقل البضائع وفقًا للاتفاقيات الدولية والقانون الأردني, حيث تكمن المشكلة في حال انعقاد مسؤوليّة الناقل الجوي نتيجة الأضرار التي لحقت بالبضائع؛ الأمر الذي يترتب عليه التزام بتقديم تعويض إلى المتضرّر، ما لم يقم الدليل على انتفاء مسؤوليته، أو لم يتمكّن من دفعها عنه، فمبالغ التعويض هذه قد تصل إلى أرقام ضخمة لا تستطيع أي شركة تحمّلها، وتفوق حجم ميزانيتها؛ مما يؤدي إلى عرقلة حركة الملاحة الجوية، وفي المقابل، قد تكون البضائع المنقولة ذات القيمة كبيرة، فإذا تضرّرت ألحقت بصاحبها خسائر فادحة. من هذا المنطلق، كان لتحديد مسؤوليّة الناقل أهميّة كبيرة، وذلك من خلال بيان الحدّ الأقصى للتعويض في كل من اتفاقيتي وارسو لعام (1929) وتعديلاتها، واتفاقية مونتريال (1999), بالإضافة إلى ذلك، بيّنت الدّراسة كيفية حساب قيمة الحدّ الأقصى للتعويض، كما بيّنت الحالات التي تشدّد فيها مسؤوليّة الناقل الجوي، وأخيرًا، بيان الوسائل التي يمكن للناقل أن يدفع بها مسؤوليته، أو يعفى منها. واتبعت الباحثة المنهج الوصفي والتحليلي للنصوص القانونية لكل من اتفاقيتي (وارسو)، و(مونتريال)، والتشريعات الأردنية الناظمة لهذا الموضوع. وفي ضوء ما تقدم؛ توصّلت الباحثة في نهاية هذه الدّراسة إلى عدد من النتائج، أبرزها: حدّدت كل من اتفاقية (وارسو)، و(مونتريال) مسؤوليّة الناقل في التعويضات التي يقدمها عند قيام مسؤوليته بحدّ أقصى لا يمكن تجاوزه، مع ورود استثناء عليه في حال تم الاتفاق على تجاوز الحدّ الأعلى بين الناقل وشاحن البضاعة قبل نقل البضائع، كما وضعت الاتفاقيتان طرقًا عديدة يستطيع الناقل بأن يدفع بها مسؤوليته. وأوصت الباحثة بأن تكون مسؤوليّة الناقل مسؤوليّة موضوعية قائمة على أساس الخطر وتحمّل التبعة تجاه الأضرار التي تصيب البضاعة في حال التأخير ؛ كون الطائرة آلة ميكانيكية تستعمل في ظروف خطرة. Abstract: The study aimed to identify the scope of the responsibility of the air carrier of goods in accordance with international laws and Jordanian law. The study dealt with determining the responsibility of the air carrier of goods and stating the maximum compensation in the Warsaw Conventions of 1929 and their amendments, and the maximum compensation in the case of transporting goods and luggage and in the case of delay in transportation in accordance with the Montreal Convention. 1999. In addition, the study showed how to calculate the value of the maximum compensation in accordance with the Montreal Convention of 1999 within the framework of the unlimited liability of the air carrier legally, with an explanation of the cases of paying the liability of the air carrier in the Warsaw and Montreal Conventions and in Jordanian legislation, and an explanation of the methods of paying liability in the Warsaw Convention of 1929 and its amendments. How to take the necessary measures to avoid the occurrence of damage, and a statement of the means of defending liability in Jordanian legislation, cases of defending liability in the Jordanian Trade Law, the Jordanian Civil Aviation Law, and exceptions to the principle of invalidity. The study used the descriptive analytical approach to the legal texts of the Warsaw and Montreal Conventions and the Jordanian legislation regulating this subject. In light of the above, at the end of this study, the researcher reached several results and recommendations, the most prominent of which is the compatibility of what is stated in the Jordanian Civil Aviation Law with the provisions of the Montreal Convention of 1999 with regard to international commercial air transport.
