Abstract
Zagadnienie pozyskiwania zasobów naturalnych ciał niebieskich zaprząta uwagę doktryny od samego początku tworzenia ram prawnych międzynarodowego prawa kosmicznego. W ostatnich latach temat zyskał nowy wymiar w związku z przyjęciem przez niektóre państwa rozwiązań na gruncie prawa krajowego, które uprawniają podmioty prywatne do wydobywania zasobów kosmicznych i czerpania z nich korzyści. Celem artykułu było wykazanie, że jedynym rozwiązaniem zgodnym z obowiązującymi regulacjami prawnymi, z których wynikają dla państw zobowiązania międzynarodowe, jest przyjęcie stosownej umowy międzynarodowej. W analizie posłużono się metodą formalno-dogmatyczną, dokonując omówienia przepisów prawa i stanowiska doktryny. Osiągnięte wyniki pozwoliły uzasadnić tezę o niezgodności ustawodawczej praktyki państw z art. I, II, III, VI i IX Układu o zasadach działalności państw w zakresie badań i użytkowania przestrzeni kosmicznej, łącznie z Księżycem i innymi ciałami niebieskimi z 1967 r. oraz o konieczności przyjęcia standardu międzynarodowego w przedmiocie pozyskiwania zasobów naturalnych ciał niebieskich.
