Les modifications récentes apportées au texte de la Loi constitutionnelle de 1867 par le Québec et la Saskatchewan ont été critiquées par les uns, saluées par les autres. Parmi les objections avancées, plusieurs prétendent que la procédure de modification unilatérale prévue à l’article 45 de la Loi constitutionnelle de 1982 ne permettrait pas, contrairement à la procédure unilatérale fédérale, d’effectuer des modifications textuelles à la Constitution du Canada, les États fédérés n’étant habilités à modifier que la substance de certaines dispositions. La présente étude tente de démontrer le contraire. Pour y arriver, les auteurs exposent, exemples à l’appui, que le droit britannique a depuis longtemps autorisé les parlements des États fédérés à modifier certains textes de loi édictés par d’autres parlements. Puis, ils font valoir que cette autorisation pouvait s’étendre également, en tout ou en partie, aux lois impériales, dont la Loi constitutionnelle de 1867. Enfin, les auteurs illustrent comment une approche interprétative limitant les États fédérés à ne modifier que la substance de certaines dispositions peut conduire à des impasses. Il en est ainsi, notamment, lorsqu’il s’agit d’adopter, conformément à l’article 55 de la Loi constitutionnelle de 1982, la version française des dispositions de la Constitution du Canada qui ont été édictées en anglais seulement.
