Sarmiza Bilcescu (1867-1935) fut la première femme, en France, à obtenir le grade de doctoresse en droit en 1890. Figure pionnière en son domaine, elle demeure cependant invisibilisée dans la recherche en histoire du droit, et plus particulièrement en histoire de la pensée juridique. Cet article vise à tirer de l’oubli ses écrits en menant une analyse de sa thèse intitulée De la condition légale de la mère ; analyse prenant en compte le genre comme élément structurant de son discours juridique. Pour ce faire, la thèse de Sarmiza Bilcescu doit s’apprécier à la lumière de son contexte d’élaboration et de parution. Le sujet de celle-ci – la maternité en droit civil – la place notamment au carrefour du droit et des féminismes de la fin du xixe siècle. Il s’agit également pour elle d’investir le monde du droit, alors hermétique aux femmes. De cette façon, les ressorts argumentatifs la menant à défendre une réforme modérée du statut juridique de la mère – sur fond de morale, d’essentialisation de la maternité et bien sûr de droit civil dont elle maîtrise parfaitement la technique – s’appréhendent d’autant mieux. Il apparaît ainsi que l’approche juridique et féministe de la maternité de la doctoresse en droit se comprend à l’aune d’un discours historiquement situé et incarné : celui d’une femme bourgeoise, pionnière en son domaine et contrainte de composer avec l’institution qu’elle aspire conquérir.
