Abstract
La Corte di Giustizia dell'Unione europea si è pronunciata in merito all'applicazione dell'art. 4, co. 3, del reg. (CE) n. 261/2004 nell'ambito di un pacchetto turistico cosiddetto "tutto compreso". La Corte ha riconosciuto il diritto dei passeggeri alla "compensazione pecuniaria", nonostante il negato imbarco non fosse dipeso dalla condotta del vettore operativo, ma fosse riconducibile al comportamento dell'organizzatore di viaggi, il quale aveva fornito ai passeggeri informazioni inesatte sull'effettuazione del trasporto. Si contesta la fondatezza di simili conclusioni, in quanto non sorrette da un fondamento legale univoco, stante la differente formulazione dell'art. 4, co. 3, del regolamento nelle varie versioni ufficiali; soprattutto, un tale assunto contrasta tanto con la Convezione di Montreal del 1999, quanto con la disciplina europea sui pacchetti turistici.
