Abstract
Nas últimas duas décadas, foram criados mais de 100 comitês de bacia hidrográfica no Brasil, com o fito de democratizar e conferir eficiência à gestão de águas. A criação desses comitês coaduna-se com o modelo de desenvolvimento que prima não apenas pelo crescimento econômico, mas pela modificação das estruturas sociais e institucionais. O objetivo do presente trabalho é analisar os aspectos jurídicos da participação da sociedade civil nos comitês de bacia e suas repercussões político-institucionais. Pretende-se examinar o caso específico do Comitê de Bacia Hidrográfica Piancó-Piranhas-Açu, a fim de verificar os resultados e os limites da participação da sociedade civil no âmbito deste comitê. Defende-se que o modelo adotado deve passar por modificações, a fim de corrigir suas falhas. Conclui-se que, apesar dos problemas apontados, os comitês de bacia hidrográfica continuam sendo importantes vetores à democratização e sustentabilidade. O método de abordagem utilizado foi o dedutivo, com a realização de pesquisa doutrinária e legislativa. Quanto ao estudo de caso, o trabalho valeu-se do exame das Atas de reuniões ordinárias e extraordinárias realizadas pelo Comitê de Bacia Hidrográfica Piancó-Piranhas-Açu, disponíveis no respectivo sítio até o ano de 2016.
