Abstract
L’article proposé porte sur le précédent en droit civil québécois. Le sujet est traité sous l’angle conjoint de la méthodologie du droit et du droit comparé, et son originalité est double. En premier lieu, la recherche repose sur des « carottes jurisprudentielles » rendant compte d’une certaine réalité de la jurisprudence québécoise, loin des idées reçues. En second lieu, elle traite non seulement de l’aspect évident de la question (la jurisprudence est-elle « liante » en droit civil québécois ?), mais aussi de la manière dont les cours évoquent les jugements rendus en droit civil et de la méthodologie qu’elles privilégient pour les analyser (ratio/obiter ou motifs/dispositif, distinctions factuelles, etc.). Bien qu’il n’ait plus été exploré à titre principal depuis environ vingt ans, le sujet demeure essentiel, car les approximations et les maladresses subsistent dans les universités et la pratique. L’analyse est évidemment personnelle, mais elle aurait au moins le mérite de relancer un débat bien négligé, notamment parce qu’on pense que tout est réglé ou que ce n’est pas important.
