Abstract
Arising out of the study of the DPA procedure according to the Organic Act on Counter Corruption (Deferred Prosecution Agreement) Bill and the Rules Procedures and Conditions of Deferred Prosecution Agreement in accord with the Organic Act on Counter Corruption B.E. 2561 Bill, there are a few significant elements that have been missing from the measure including; confidentiality, a condition to compensate victim, court approval, and publication of DPA. As a result, the Thai DPA remains currently deficient. This individual study seeks the approaches to improve those deficiencies by analyzing the principles, theories, and legal provisions in the United Kingdom, France, and Canada; apparently, those countries set the four elements into their procedures with distinct details that defer to the countries, since they are a component of crucial mechanisms for the measure. Therefore, the researcher proposes establishing the four missing elements within the Organic Act on Counter Corruption (Deferred Prosecution Agreement) Bill and the Rules Procedures and Conditions of Deferred Prosecution Agreement in accord with the Organic Act on Counter Corruption B.E. 2561 Bill in pursuance of the efficacy of Thai DPA.
