Abstract
Depuis les échecs des grandes rondes de négociations constitutionnelles, la procédure des arrangements spéciaux prévue à l’article 43 de la Loi constitutionnelle de 1982 est l’avenue la plus souvent invoquée lorsqu’il s’agit de modifier une disposition de la Constitution du Canada. Le présent texte propose un nouveau cadre d’analyse de cette procédure permettant de mieux comprendre la relation qu’elle entretient avec les autres procédures de modification composant la partie V de la Loi constitutionnelle de 1982 . Pour y parvenir, les auteurs mettent d’abord en lumière une classification centrée sur l’identification des organes étatiques touchés par ces arrangements. Ils esquissent ensuite la méthode à suivre afin d’édicter de nouveaux arrangements spéciaux. À cet égard, ils extirpent, à partir des arrangements existants, deux critères permettant de distinguer les dispositions constitutionnelles pouvant être modifiées soit par la procédure des arrangements spéciaux, soit par la procédure de modification unilatérale provinciale. Enfin, les auteurs montrent comment la procédure des arrangements spéciaux ne peut à elle seule résoudre les difficultés relatives à l’adoption d’une version française des dispositions édictées en anglais seulement.
