El propósito de este trabajo radica en analizar la disciplina de la publicidad de los criptoactivos contenida en el Reglamento MICA. Para ello creemos oportuno partir de la exposición de los problemas que estaban presentes en la publicidad comercial de los criptoactivos en la situación de ausencia de regulación con la finalidad de poder, posteriormente, analizar la regulación del Reglamento MICA y comprobar si efectivamente los logra solventar. Son dos las novedades principales a través de las cuales el Reglamento MICA pretende resolver los problemas de transparencia y desprotección del inversor que existían en el mercado de los criptoactivos. Por un lado, el referido a la estructura del mercado de los criptoactivos y, por el otro, el referido a la publicidad de los criptoactivos. El primero consigue la protección del inversor a través de la regulación de la estructura del mercado, determinando los operadores que pueden desplegar las actividades en este mercado y los requisitos que han de cumplir para ello, especialmente requisitos de solvencia y de transparencia, que como consecuencia del análisis que de la información hacen los inversores institucionales y los analistas, protegen al inversor minorista porque promueven la correcta formación de los precios y la integridad del mercado. Por su parte, el régimen de la publicidad comercial de los criptoactivos persigue proteger a los inversores minoristas asegurando la existencia de una competencia efectiva y leal que permita que los inversores puedan tomar decisiones libres y autónomas.
