Abstract
En la resolución de las crisis matrimoniales en donde hay menores implicados debe tenerse en cuenta la guarda y custodia de estos. Uno de los modelos que se vienen estudiando desde hace un tiempo es el sistema de casa nido. En este artículo analizamos las ventajas que encontramos muy escasas frente a las dificultades que las partes deben asumir, sin señalar la necesidad de un compromiso y un respeto muy estricto entre las partes para que el modelo pudiera ser eficiente. La clave del establecimiento de la guarda y custodia de los menores es el interés superior de los mismos, por lo que se deberán evaluar las circunstancias de cada caso para poder indicar cuál es el mejor modelo para cada situación. Esto sin tener en cuenta que las vías extrajudiciales, como puede ser la mediación, serán las mejores para establecer modelos tan sensibles como puede ser el de casa nido. Por ello analizamos la Sentencia del Tribunal Supremo 1312/2024 en donde se declara improcedente la imposición del sistema de casa nido en la atribución de la vivienda familiar en las custodias compartidas sin que haya acuerdo de los progenitores.
