En los problemas que surgen de la determinación de la filiación deben tenerse en cuenta muchas cuestiones, entre ellas si nos encontramos ante un caso de filiación matrimonial o no matrimonial. Otra cuestión que debemos tener en cuenta es la determinación de la filiación en los supuestos de técnicas de reproducción asistida, especialmente en estos casos en los que se lleva a cabo por una sola mujer, sin pareja estable ni consentimiento de otra persona, pero sin embargo surgen polémicas respecto de la filiación del menor con respecto a terceras personas. En este artículo analizamos estos conceptos en materia de filiación que en ocasiones pueden resultar difusos y pueden generar controversia, resolviéndose todas estas cuestiones por la jurisprudencia. Por ello analizamos la Sentencia del Tribunal Supremo 1526/2024 en donde se discute entre dos personas la filiación de la menor en una relación no matrimonial, habiendo sido su concepción a través de técnicas de reproducción asistida en las que nada ha tenido que ver el varón.
