Abstract
Este artigo propõe uma análise teórica crítica sobre o lugar da mediação de conflitos nas sociedades contemporâneas sob hegemonia neoliberal. A mediação, frequentemente promovida como alternativa democrática e desjudicializadora, será examinada como tecnologia social ambivalente. Parte-se da hipótese de que, ao mesmo tempo em que pode representar uma ferramenta de responsabilização individual e desmonte do papel público do Estado, a mediação também pode configurar espaços de resistência, emancipação e reconstrução do vínculo comunitário. A discussão articula os aportes de Foucault (2008), Brown (2019), Laval e Dardot (2016), Santos (2007) e Gohn (2011), entre outros, no intuito de tensionar o uso institucional da mediação com suas apropriações populares e insurgentes. O artigo adota como método a revisão bibliográfica crítica e a análise conceitual, situando o debate nas fronteiras entre o direito, a sociologia política e a teoria crítica. O objetivo central é compreender de que forma a mediação pode tanto reproduzir a lógica de pacificação e adaptação neoliberal quanto abrir fissuras nas estruturas hegemônicas. Ao problematizar a mediação como dispositivo político e não como técnica neutra, o texto busca contribuir com reflexões estratégicas sobre justiça, cidadania e resistência no contexto de retração de direitos e crise da esfera pública.
