Abstract
The article presents a comprehensive study of mediation as an instrument for the humanisation of justice in disputes concerning the determination of a child's residence and participation in upbringing.The relevance of the topic is determined by the growing number of family conflicts accompanied by prolonged court proceedings that cause psychological trauma to minors.Based on an interdisciplinary approach, the research combines legal, psychological, and social methods of analysis, which has made it possible to reveal the normative, ethical, and communicative aspects of the application of mediation.Particular attention is devoted to international legal standards, including the provisions of the United Nations Convention on the Rights of the Child, the Recommendations of the Council of Europe, and the case law of the European Court of Human Rights, all of which establish the primacy of protecting the interests of the child in family legal relations.The article also analyses Ukrainian legislation, including the Law of Ukraine "On Mediation", the Family Code, and the Civil Procedural Code, identifying regulatory gaps that hinder the effective implementation of this procedure.The article describes the psychological conditions of a child's participation in mediation, in particular the consideration of the child's age, emotional state, and level of maturity.The role of the mediator is defined as that of a facilitator who assists the parties in moving from confrontation to constructive dialogue.A comparative analysis of foreign experience (Germany, Canada, and the United States) is carried out, demonstrating how mediation has been integrated into the system of family justice.The study proposes ways to improve national practice: introducing judicial information sessions to inform parties about the possibility of mediation, establishing unified standards for mediator training, developing interdisciplinary education, and promoting state-supported awareness programmes.It is substantiated that mediation in disputes concerning children is not only an alternative but also a humanistic means of conflict resolution, which ensures the child's emotional well-being, reduces social tension, and contributes to the formation of a culture of peaceful dialogue within society.
