Cette étude de cas porte sur la divulgation d’actes répréhensibles par Yacine Agnaou, ancien procureur de la Couronne au Canada. Monsieur Agnaou avait recommandé des poursuites contre une entreprise canadienne non identifiée, mais sa hiérarchie l’en a empêché– ce qui pourrait constituer une atteinte à l’indépendance des procureurs. Après avoir signalé cette situation en interne, il a ensuite perdu son emploi, et malgré des années de démarches judiciaires, il n’a pas réussi à obtenir réparation pour cette sanction. Puis, en 2019, un scandale impliquant les poursuites contre SNC-Lavalin a éclaté au grand jour. Cette fois, c’est la procureure générale elle-même qui a joué le rôle de lanceuse d’alerte. Cette nouvelle affaire est venue corroborer les préoccupations soulevées par Yacine Agnaou. Afin de mieux comprendre les défaillances du système et de faire progresser la théorie sur les conséquences du lancement d’alerte, cette étude examine le cas Agnaou à la lumière de deux théories existantes : l’une développée par les pionniers de la recherche sur le lancement d’alerte, Marcia Miceli, Janet Near et Terry Dworkin, et l’autre par les chercheurs du projet australien Whistling While They Work. L’étude se conclut par des propositions d’amélioration des théories existantes, une discussion sur les implications pratiques du cas Agnaou, et plusieurs recommandations pour améliorer la Loi sur la protection des fonctionnaires divulgateurs d’actes répréhensibles du Canada.
