Je remercie très sincèrement ma directrice de recherche madame Diane Veilleux, pour son encadrement, ses précieux conseils et commentaires tout au long de la réalisation de ce travail.Je tiens à exprimer ma reconnaissance à mon conjoint Eustache Goore ainsi qu'à mes parents Ema et Euphemi pour leurs encouragements et le soutien qu'ils m'ont apporté tout au long de ces années d'études.Grace à eux j'ai bénéficié de toutes les conditions idéales pour mener à biens mes études.Merci également à tous les autres membres de ma famille et amis pour m'avoir épaulée.Résumé Le harcèlement psychologique représente un danger auquel le travailleur est exposé durant l[xercice de son travail.En effet, le harcèlement psychologique étant susceptible dltérer la santé physique ou mentale de lLmployé constitue un risque professionnel.Pour contrer ce risque professionnel, les législateurs français et québécois ont posé une interdiction visant à protéger les milieux de travail de ce fléau.Le but de ce mémoire est de mener une réflexion sur lÏ1iterdiction législative du harcèlement existant en France et au Québec afin dtidentifier les déterminants dans lime et Lautre juridiction qui permettent au salarié de croire qui) bénéficie dimne véritable protection en matière de harcèlement moral dimne part et dautre part qui incitent les employeurs à mettre cette protection en uvre au sein de leur entreprise.Pour réaliser notre recherche, nous avons procédé à une étude comparée des législations française et québécoise qui prohibent le harcèlement psychologique, et procédé à des illustrations jurisprudentielles pour voir comment cette interdiction se matérialise.Nous avons constaté des similitudes et différences relevant des deux interdictions.Mais surtout, nous sommes arrivées à la conclusion que ces deux lois, tenant compte du contexte dans lequel elles sappliquent, permettent de réaliser les objectifs visés par le législateur.
