Abstract
This paper reviews the Canadian rail freight market, establishes market definitions, and explains the nature of the market power enjoyed by railroad companies operating in Canada. It also discusses shipper remedies and their qualitative effects and effectiveness in regulating some of that market power. This leads to an analysis of the extent to which the market and shipper remedies drive price and output decisions of rail carriers. Canadian freight railroad companies enjoy tremendous market power, and in the current regulatory state of affairs, railroad companies have too much ability to retain a producer surplus while their customers are left with an unsatisfactory level of consumer surplus. Although neither shippers nor railroads would benefit from the abolition of differential pricing or the return to federally-regulated freight railways, existing remedies such as final offer arbitration should be strengthened and expanded.
