Abstract
RESUMO O propósito deste trabalho é apresentar uma análise sobre a viabilidade de adquirir propriedade por meio de usucapião de imóveis vinculados ao Sistema Financeiro de Habitação, política habitacional iniciada em 1964 em colaboração com o Banco Nacional de Habitação, responsável pelo seu gerenciamento à época. A pesquisa concentra-se especialmente nos bens imóveis financiados pela Caixa Econômica Federal, sucessora do Banco Nacional de Habitação e principal entidade financeira na execução de políticas habitacionais no país. O objetivo é apresentar uma perspectiva contrária aos argumentos utilizados pela jurisprudência dominante para indeferir os pleitos de usucapião desses imóveis. Para isso, são abordados o conceito de bens públicos previsto na legislação, o regime jurídico a que estão submetidas as empresas públicas que exploram atividade econômica, conforme estabelecido na Constituição Federal, além da posição jurisprudencial e doutrinária sobre o tema. Também é examinada a postura adotada pelo Poder Judiciário diante do direito fundamental à moradia, com reflexões sobre a responsabilidade do Estado Democrático de Direito em dar efetividade aos preceitos constitucionais, utilizando-os como balizas em todas as suas decisões e interpretações legislativas. Para conduzir esta análise, são empregados métodos de pesquisa bibliográfica e documental, incluindo a análise jurisprudencial e da legislação pertinente à temática.
