Abstract
Το δικαίωμα ανάληψης συλλογικής δράσης από τις συνδικαλιστικές οργανώσεις των εργαζομένων αποτελεί αναγνωρισμένο από το ΔΕΚ μέρος της κοινοτικής έννομης τάξης. Η παρούσα εργασία εξετάζει τις περιπτώσεις σύγκρουσης του εν λόγω δικαιώματος με τις θεμελιώδεις κοινοτικές οικονομικές ελευθερίες. Συγκεκριμένα, με βάση τις υποθέσεις Viking και Laval, επιχειρείται μια συστηματική παρουσίαση της μεθόδου εναρμόνισης των συγκρουόμενων συμφερόντων. Το δικαίωμα συλλογικής δράσης, μέσα από τον έλεγχο αναλογικότητας του ΔΕΚ, χρησιμοποιείται ως δικαιολογητική βάση περιορισμών στις ελευθερίες των αρ 43 και 49 ΣΕΚ, ενώ σκιαγραφούνται τα όρια και οι νόμιμοι επιδιωκόμενοι σκοποί της δράσης. Μέσα από έναν αυστηρό έλεγχο αναλογικότητας, το ΔΕΚ καταλήγει να δημιουργεί μια ιεράρχηση υπέρ των ελευθεριών, η οποία απορρυθμίζει τα δικαιώματα συλλογικού αγώνα και οδηγεί σε μια ασύμμετρη θεσμική ευρωπαϊκή ολοκλήρωση, όπου το οικονομικό σκέλος προπορεύεται του κοινωνικού.
