본 논문은 캐나다 원주민 대상 진실화해위원회(TRC) 활동을 중심으로, 식민주의 폭력의 과거사 청산에서 회복적 정의가 어떤 성과와 한계를 드러내는지 분석한다. 캐나다 정부와 교회가 운영해온 인디언 기숙학교 제도는 수십만 원주민 아동에게 집단 트라우마와 문화 말살을 초래했고, 2008년 설립된 TRC는 이 문제에 대해 공식 사과, 배상, 문화 복원 등 다양한 조치를 시도했다. 이는 회복적 정의의 논리로 볼 때, 국가가 피해자들의 역사와 고통을 어느정도 인정하고 일정한 회복을 시행했다는 점에서 의미가 있다. 그러나 글렌 콜타드(Glen Coulthard)와 마크 리프킨(Mark Rifkin)이 지적하듯, 정착민 식민주의 구조가 유지되는 한, 국가가 사과나 한시적 보상만 제공하고 토지·자치권 등 핵심 권력은 넘기지 않아 현재진행형 지배가 지속될 위험이 크다. 또한 질 스토퍼(Jill Stauffer)의 ‘윤리적 고독(Ethical Loneliness)’ 관점에서 보면, 피해자들이 공적으로 발언했음에도 실질적 응답(responsibility)이나 제도 개혁이 따르지 않으면 2차적 상처를 입을 수 있다. 본 논문은 이러한 관점들을 종합하여 캐나다 진실화해위원회사례를 평가하고, 식민주의를 넘어서기 위한 탈식민(decolonization)적 개선 방향을 제안한다.캐나다 진실화해위원회활동은 한국의 과거사 청산이 ‘공식 인정 및 사과 → 배상과 회복 → 제도 개혁’으로 이어지는 일련의 과정 속에서, 지속성과 구조적 변화라는 키워드를 놓치지 말아야 함을 일깨워준다. 피해자에 대한 진정성 있는 응답과 권력 배분, 장기적인 피해 공동체 복원 프로그램, 독립적인 후속 이행 기구 등은 한국에서도 더욱 강화되고 발전되어야 할 핵심 과제이다.
