Abstract
Постановка проблеми. Питання імплементації міжнародних стандартів доказування у кримінальному процесі України набуло особливої актуальності у зв’язку з необхідністю гармонізації національного законодавства з міжнародними вимогами, ефективною протидією транснаціональній злочинності, забезпеченням прав людини та у контексті ратифікації Римського статуту МКС. Мета – з’ясування сутності міжнародних стандартів доказування у кримінальному процесі України, окреслення їх ознак, значення для правозастосовної практики, а також визначення проблем і перспектив імплементації. Застосовані методи: системного аналізу – для виявлення взаємозв’язків між міжнародними та національними стандартами доказування; формально-юридичний – для тлумачення міжнародно-правових актів та рішень міжнародних судових інституцій; порівняльно-правовий – для зіставлення норм міжнародного та українського кримінального процесуального права; історико-правовий – для дослідження етапів становлення міжнародних стандартів доказування. Результати. Окреслено основні сутнісні ознаки міжнародних стандартів доказування: відповідність правам людини, пріоритетність міжнародного права, визначеність, універсальність, гнучкість, процесуальні гарантії, вплив на хід і результат провадження, а також орієнтація на практику міжнародних судів. Доведено, що в умовах збройного конфлікту актуальним є використання практики Міжнародного кримінального суду, Міжнародного трибуналу щодо колишньої Югославії та Міжнародного кримінального трибуналу по Руанді для забезпечення справедливого судочинства. Висновки. Міжнародні стандарти доказування є необхідною умовою легітимності кримінального провадження в Україні. Їх повна імплементація вимагає адаптації національного законодавства, формування відповідної правозастосовної практики та врахування рішень міжнародних судових інституцій, що є особливо важливим у контексті сучасних викликів, пов’язаних із воєнним станом та міжнародним правосуддям. Problem statement. The issue of implementing international standards of evidence in the criminal procedure of Ukraine has gained particular relevance in connection with the need to harmonize national legislation with international requirements, ensure effective counteraction to transnational crime, protect human rights, and in the context of the ratification of the Rome Statute of the ICC. Purpose. To clarify the essence of international evidentiary standards in the criminal procedure of Ukraine, outline their features, significance for law enforcement practice, and identify challenges and prospects for implementation. Methods Used: System analysis – to identify interrelations between international and national evidentiary standards; Formal legal method – for interpreting international legal acts and decisions of international judicial institutions; Comparative legal method – for comparing the norms of international and Ukrainian criminal procedural law; Historical legal method – for studying the development stages of international evidentiary standards. Results. The key substantive features of international evidentiary standards have been outlined, including: compliance with human rights, primacy of international law, legal certainty, universality, flexibility, procedural guarantees, influence on the course and outcome of proceedings, and orientation toward the practice of international courts. It is substantiated that under the conditions of armed conflict, it is especially relevant to apply the practice of the International Criminal Court, the International Criminal Tribunal for the former Yugoslavia, and the International Criminal Tribunal for Rwanda to ensure fair trial standards. Conclusions. International evidentiary standards are a necessary condition for the legitimacy of criminal proceedings in Ukraine. Their full implementation requires the adaptation of national legislation, development of corresponding law enforcement practices, and consideration of decisions of international judicial institutions. This is particularly important in the context of current challenges related to martial law and international justice.
