Abstract
У статті досліджується процес гармонізації норм міжнародного права щодо захисту українських біженців у правових системах США та Канади, що набув особливого значення після початку збройної агресії російської федерації проти України 24 лютого 2022 року та, відповідно, міграційної кризи, яка розпочалась внаслідок бойових дій. Акцент зроблено на співвідношенні міжнародно-правових механізмів захисту біженців, закріплених у Конвенції про статус біженців 1951 року та Протоколі щодо статусу біженців 1967 року, а також в інших міжнародних та регіональних нормативних актах, з нормами, закріпленими у національних правових системах обох країн, зокрема з програмами Uniting for Ukraine у США та Canada-Ukraine Authorization for Emergency Travel у Канаді. Аналізується, якою мірою імплементація міжнародних зобов’язань вплинула на створення спеціальних правових механізмів для біженців з України. Розглядаються питання відповідності таких заходів принципам недискримінації, невислання та забезпечення належних процедур визначення статусу. Окрему увагу також приділено тому, як нормативна база та існуючі інституційні механізми співвідносяться з реальним впровадженням програм, з урахуванням наукових підходів, адміністративної практики, судових рішень і позицій відповідних міжнародних інституцій. У роботі сформульовано висновок про поступову конвергенцію окремих інститутів гуманітарної політики США та Канади з уніфікованими міжнародно-правовими стандартами у сфері захисту біженців, незважаючи на збереження національної специфіки правозастосування та вплив політичного контексту кризового реагування.
