Canadá – Energía renovable hace parte de un conjunto de controversias resueltas por el Órgano de Solución de Diferencias de la Organización Mundial del Comercio que refleja las tensiones ampliamente reconocidas entre comercio y medio ambiente. En concreto, la citada disputa se refiere al fomento estatal a la transición energética y se suele presentar como un avance significativo ante los obstáculos que impone la normativa internacional para la descarbonización de la economía. Sin embargo, este progreso no es absoluto. Como sostendrá este texto, si bien el Órgano de Apelación elaboró una interpretación del Acuerdo sobre Subvenciones y Medidas Compensatorias (ASMC) que resulta favorable para la evaluación de incentivos estatales a la transición energética, no hizo lo mismo respecto del Acuerdo General sobre Aranceles Aduaneros y Comercio (GATT). Por el contrario, al evaluar los programas impugnados a la luz de este último, el Órgano de Apelación reprodujo su lógica convencional, privilegiando los intereses de liberalización de los mercados sobre la inminente necesidad de acelerar la transición energética a través de políticas de fomento estatal. En esencia, considerando el panorama actual, los obstáculos para incentivar la descarbonización de las economías no están dados por el ASMC, sino por el GATT. En consecuencia, Canadá – Energía renovable sugiere que la transición energética dista de contar con un marco jurídico sólido que, en su integridad, le otorgue a los Estados un margen regulatorio suficiente para conceder incentivos económicos en esta materia.
