Abstract
Praca składa się z trzech zasadniczych działów. Te działy to: 1) Ustalenia terminologiczne i metodologiczne oraz zakreślenie obszaru badawczego, 2) Dzieło sztuki jako podstawa refleksji o charakterze filozoficznoprawnym i teoretycznoprawnym oraz 3) Dzieło sztuki jako podstawa reakcji prawnej (poprzez naruszenie przez dzieło sztuki określonych regulacji prawnych). W pierwszym dziale dokonane zostało uporządkowanie terminologicznego i wskazanie obszaru istotnego dla pracy – chodzi o rozwinięcie perspektywy estetyki prawa w ujęciu zewnętrznym. W drugim dziale skonfrontowana została interpretacja tekstu literackiego i tekstu prawnego, wskazując na podobieństwa i zasadnicze różnice w modelach interpretacji tekstów literackich i prawnych. W dalszych częściach działu drugiego następuje odwołanie do trzech „klasycznych” dzieł literackich – powieści „Bracia Karamazow” Fiodora Dostojewskiego, opowiadania „Upadek” Alberta Camus oraz opowiadania „Przed prawem” Franza Kafki. Z fabuł „ekstrahowane” zostają określone problemy filozoficznoprawne, które poddane zostają dalszej analizie przy użyciu narzędzi i siatki pojęciowej wypracowanej przez prawoznawstwo. I tak w przypadku „Braci Karamazow” jest to problem odpowiedzialności oraz wynikający z tego zagadnienia dialogiczny model prawa, w przypadku „Upadku” tym problemem jest konstrukcja prawa do sądu, a w przypadku „Przed prawem” potencjalna autopoietyczność systemu prawa. W trzecim dziale wskazane zostaje, jak dzieła sztuki wchodzić mogą w polemikę z określonymi regulacjami prawnymi – w tym kontekście przedstawione zostały dzieła sztuki naruszające normy prawa karnego materialnego oraz polemizujące ze znaną prawu administracyjnemu konstrukcją ładu przestrzennego.
