I popoli indigeni possono dirsi composti dai discendenti viventi di coloro che risiedevano su terre usurpate da uomini di differente cultura o origine etnica provenienti da altre parti del mondo. Il motivo per il quale al centro di molti dibattiti dottrinari vi sono i popoli autoctoni risiede nella constatazione che gli indigeni sono stati privati dei loro diritti da parte dei colonizzatori. In particolare essi hanno perso la terra che tradizionalmente occupavano e la possibilità di promuovere e sviluppare costumi e valori appartenenti alla loro cultura. I popoli nativi rischiano di perdere la propria identità e incontrano serie difficoltà ad adeguare i loro costumi e le loro tradizioni a nuove condizioni di vita. Benché i loro diritti siano oggetto di tutela internazionale emerge con chiarezza la necessità primaria di accogliere le rivendicazioni ancestrali a livello statale. \nLe esperienze federali canadese e statunitense offrono una panoramica sufficientemente completa delle tematiche inerenti alla valutazione dello status di aborigeni all’interno di una realtà articolata su due livelli (statale e federale) con i quali gli indigeni sono costretti a rapportarsi.
