Negli ultimi venti anni, numerose direttive europee evidenziano le linee di sviluppo del diritto d’autore di fronte alle trasformazioni dell’innovazione tecnologica e alle sfide del mondo digitale. Il presente saggio rileva lo stretto legame tra alcuni interventi volti a modificare una serie di norme (durata del diritto d’autore rapporto con i diritti connessi, droit de suite) o a escluderne altre (diritti morali) e a ricostruzione storica delle loro origini e della loro evoluzione nei sistemi europei del XIX e del XX secolo. L’approfondimento della natura dei diritti sulle opere dell’ingegno, infatti, ha sempre attratto l’attenzione della dottrina più avvertita che ha lamentato la carenza di indagini dettagliate per definirne la configurazione, i rapporti con il diritto proprietario e l’autonomia delle prerogative di carattere personale. Alcuni problemi lasciati aperti dai secoli precedenti non trovano soluzione né nelle principali direttive europee né nella proposta di direttiva sul diritto d’autore nel mercato unico digitale del 2016, che vuole la modernizzazione del diritto d’autore per armonizzare la diversità culturale in Europa. Dopo una prima influenza del sistema europeo sul mondo angloamericano, oggi le direttive si rivolgono piuttosto a quest’ultimo, con una tendenza rischiosa rispetto ai saldi principi che provengono dal sistema del droit d’auteur. Per queste ragioni, nel presente saggio il sistema europeo è spesso messo in relazione con il Nord America e in particolare con il Canada, che presenta aspetti meno conosciuti, ma soprattutto più vicini a quelli dell’Europa continentale.
