Au milieu des années quarante au Québec et au Canada, on assiste à la mise en place d’un nouveau régime de relations du travail, marqué par une intervention accrue de l’État. Le contexte de la Seconde Guerre mondiale est crucial pour comprendre une conjoncture ponctuée par le plein emploi, une inflation galopante, une poussée importante du syndicalisme et une période d’expérimentation législative poussant à sa limite le régime libéral de relations du travail. Au Québec, c’est la Loi instituant une commission des relations ouvrières et la Loi des différends entre les services publics et les salariés à leurs emplois, toutes les deux adoptées en 1944, qui incarnent ce nouveau régime de relations de travail. Elles instaurent l’arbitrage obligatoire, la négociation collective obligatoire, l’encadrement légal de la grève, l’accréditation syndicale et créent la Commission des relations ouvrières. Le but de notre étude est d’expliquer la genèse de ces deux lois majeures, dont les principes sont, encore aujourd’hui, fondamentaux au régime normatif de régulation des relations du travail. À l’aide de l’important Fonds d’archives E24 du ministère du Travail situé à Québec, nous explorons cette période charnière afin de rendre compte des enjeux cruciaux de la crise des relations du travail au Québec qui a mené à l’adoption de la nouvelle législation.
