Abstract
Tutkielman tarkoituksena oli selvittää kattavasti alle 15-vuotiaaseen rikollisen teon tehneeseen lapseen kohdistuvat seuraamukset oikeuskirjallisuuden, lakien esitöiden sekä vallitsevan oikeuskäytännön pohjalta. Seuraamusjärjestelmän ohella tutkittiin lasten rikollisuuden kehitystä tilastojen avulla.¨ \n \nLasten rikollisten tekojen seuraamukset painottuvat lastensuojelullisiin toimenpiteisiin. Suomen järjestelmää voidaankin kuvailla huoltomalliksi, jossa huomio keskitetään lapsen tukeen ja hoitoon rangaistusten sijasta. Alle 15-vuotiaisiin pystytään kuitenkin soveltamaan laajalti myös muita seuraamuksia. Erityisesti vahingonkorvausvelvollisuus voi muodostua lapselle erittäin raskaaksi rikollisen teon seuraamukseksi. Lasten rikollisuuden kehityssuuntana on viime aikoina ollut rikollisten tekojen kasautuminen pienelle osalle lapsista, kun samanaikaisesti yhä suurempi osa lapsista pidättäytyy rikollisista teoista kokonaan. \n \nAlle 15-vuotiaisiin lapsiin rikollisten tekojen johdosta kohdistuva seuraamusjärjestelmä näyttäisi lähtökohtaisesti toimivalta. Ongelmana lapsiin kohdistuvan seuraamusjärjestelmän arvioinnissa on kuitenkin se, että yleisimmistä puuttumiskeinoista eli lastensuojelullisista toimenpiteistä sekä sovittelusta puuttuvat vaikuttavuustutkimukset käytännössä kokonaan, joten emme tiedä mikä merkitys kyseisillä toimenpiteillä on lasten rikollisten tekojen jatkamiseen.
