El Convenio de Montreal de 1999, base de nuestro estudio, se fundamenta en una serie de principios fundamentales que lo estructuran, así por ejemplo se estructura sobre la base del contrato de transporte aéreo pues el convenio aplica únicamente entre partes contractuales, por tanto, la responsabilidad surge del incumplimiento de las obligaciones contractuales. Para el caso de daños a los pasajeros que impliquen muerte o lesión corporal se establece una responsabilidad ilimitada articulada en dos niveles, a saber, un primer nivel limitado a 100.000 DEG en donde se establece una responsabilidad de tipo objetivo, de manera que el transportista no puede eximir su responsabilidad, y un segundo nivel a partir de la suma antes indicada e ilimitado estableciéndose un régimen de responsabilidad de tipo subjetivo. Por otra parte para el caso del daño producido por retraso en las operaciones del transportista se establece una responsabilidad de tipo subjetivo y limitada. El Convenio también instaura la posibilidad de que los Estados implanten un sistema de pagos adelantados y la obligación de que estos les exijan a los transportistas la contratación de un seguro que pueda cubrir su eventual responsabilidad. Asimismo se establece la quinta jurisdicción, mediante la cual un pasajero afectado por un daño producido durante la ejecución de un contrato de transporte aéreo puede plantear la acción resarcitoria en el lugar de su domicilio principal, siempre y cuando el transportista posea una oficina en ese lugar.
