[ES] En sendos procedimientos, Hungría y Polonia solicitan al Tribunal de Justicia de la Unión Europea que anule la Directiva (UE) 2018/957 que modifica la Directiva 96/71/CE sobre el desplazamiento de trabajadores. Cuestión que se dilucida en las Sentencias de 8 de diciembre 2020, C-620/18 y C-626/18, objeto de este comentario. Ambos países consideran que la protección reforzada otorgada a los trabajadores por la Directiva (UE) 2018/957 excede de lo permitido por las disposiciones del Tratado en materia de libre prestación de servicios; ya que evita que determinados países puedan prevalerse de su «ventaja competitiva» en materia de costes sociales. Por ello, el Tribunal tendrá que resolver (a) si la elección de la base jurídica de la Directiva (UE) 2018/957 es la correcta; (b) si los desplazamientos de larga duración tienen una protección excesiva y el principio de igualdad retributiva es contrario al Tratado; (d) si se vulnera la doctrina Laval al garantizar los derechos colectivos, incluido el derecho de huelga, de los trabajadores desplazados; y si (e) se produce el incumplimiento del Reglamento (CE) n. 593/2008 del Parlamento Europeo y del Consejo, de 17 de junio de 2008, sobre la ley aplicable a las obligaciones contractuales (Roma I), así como la vulneración de los principios de seguridad jurídica y de claridad normativa. Cuestiones que se resuelven por el tribunal introduciendo un nuevo parámetro de valoración «constitucional» de la Directiva (UE) 2018/957: su adecuación al principio de «libre prestación de servicios en condiciones equitativas»: Lo cual supone, por sí mismo, una refundación jurisprudencial de la Directiva 96/71/CE sobre desplazamiento trasnacional de trabajadores.
