El presente investigación es del tipo descriptiva, con un enfoque cualitativo, de \ndiseño de teoría fundamentada; con el objetivo general de analizar de qué manera \nla imputación necesaria realizada por el Ministerio Público en el proceso inmediato \npor delito de omisión a la asistencia familiar incide en el principio acusatorio del \ncódigo procesal penal en el Distrito Fiscal de Lima, 2016; así también, se planteó \ndos objetivos específicos complementarios al objetivo general planteado \ninicialmente; los cuales fueron determinar de qué forma la capacidad económica \ndel imputado se relaciona con la carga de la prueba del Ministerio Público en la \nincoación del proceso inmediato por delito a la omisión a la asistencia familiar en el \nDistrito Fiscal de Lima, 2016 y, por otro lado, establecer de qué manera la omisión \nalimentaria como supuesto de aplicación del proceso inmediato restringe el \nejercicio público de la acción penal del Ministerio Público, en el Distrito Fiscal de \nLima, 2016. Con el fin de obtener los objetivos trazados en la presente \ninvestigación, se aplicó la técnica de la entrevista, encuesta, análisis de sentencias \ny del marco normativo; resultados que fueron destinados a la comprobación de los \nsupuestos jurídicos planteados al inicio de la investigación a partir de la formulación \ndel problema general y específicos respectivamente.
