La question de savoir si les animaux ont des droits hante aujourd’hui les sociétés occidentales, y compris celle québécoise. Cette problématique, inséparablement philosophique et juridique, décentre notre regard pour le poser sur l’animal. Or lui reconnaître des droits, fussent-ils moraux ou légaux, présuppose des rapports et des processus sociaux, c’est-à-dire des luttes sociales et symboliques, réductibles aux dynamiques de la société, des normes, des institutions humaines. Si bien que les enjeux et les ressorts de la problématique sont, non pas seulement philosophiques et juridiques, mais sociologiques. Dans cette perspective, les mutations contemporaines du droit animalier, qui s’observent aux plans tant national qu’international, constituent autant de discours normatifs emportant des effets sur les rapports sociaux. Inscrit dans le sillage de la sociologie juridique, le présent mémoire propose plus précisément de revisiter la réforme du droit animalier québécois, législative d’une part et jurisprudentielle d’autre part, au prisme de la sociologie de l’État et du droit de Pierre Bourdieu. À l’investigation juridique se superpose cet arrière-plan théorique, une démarche exploratoire dont l’objectif est de baliser un dialogue interdisciplinaire qui, en mettant en exergue la dynamique ainsi que le particularisme du droit animalier, dessine une réflexion sur ses propriétés et ses fonctions proprement sociales.
